GENERAL TERMS AND CONDITIONS FOR PRIVATE CUSTOMERS

SUBSCRIPTION TERMS AND CONDITIONS FOR MYCALL, PART OF TELIA NORGE AS (ORG.NO. 981 929 055). EFFECTIVE FROM 01/05/2025

1. Scope and Parties

These general terms and conditions apply to services (hereafter referred to as “the Services”) provided by Mycall, a part of Telia Norge AS org. no. 981 929 055 (hereafter referred to as “Mycall”), to consumers (hereafter referred to as “the Customer”).

The Customer must be over 18 years of age, except for prepaid cards where the minimum age is 15 years, and is registered with Mycall as the contracting party. The Customer is responsible for payment and use of the Services and subscriptions covered by the agreement entered into between the Customer and Mycall (“the Agreement”), even where the Customer has given other persons (hereafter referred to as “the User”) access to the Services. It is the Customer’s responsibility to ensure that the Agreement is known and complied with by Users at all times.

2. Entering into the Agreement and Agreement Documents

The Agreement is considered entered into when Mycall has received and approved an order for a Service from the Customer.

Mycall’s written approval may be given electronically and through automated processes. Mycall may decline the order if there is objective reason, for example if the Customer does not have sufficient creditworthiness, in cases of previous misuse of the Services, geographical restrictions, or circumstances that make it disproportionately costly to provide the Services.

The Agreement as a whole consists of specific terms agreed in writing (see offer, order, order confirmation and/or information on My Pages), the general terms and conditions for private customers (these terms), and the service-specific terms for the Services ordered. The service-specific terms are available at www.mycall.no/privacy-and-cookies.

Mycall’s service-specific terms contain certain provisions that differ from the general terms. In the event of a conflict, the service-specific terms will take precedence over the general terms. Non-derogable statutory provisions take precedence over both Mycall’s general and service-specific terms in case of conflict.

If the Services are used without a written agreement being entered into, the Customer is considered to have accepted the terms of the Agreement.

3. Delivery

Delivery takes place when the Customer is given access to the Services, unless otherwise specifically agreed.

Mycall does not guarantee that the Services will be delivered without faults or interruptions, for example due to weather conditions, damage to infrastructure, necessary maintenance, topographical conditions, network capacity, unforeseen technical complications, etc.

The Agreement does not entail any transfer of material or immaterial rights to the Services or equipment.

4. Credit Assessment and Credit Limit

Mycall has the right to set credit limits and obtain a credit assessment of the Customer before entering into the agreement and during the contractual relationship when there is a valid reason.

If the Customer exceeds the credit limit or if the credit assessment in Mycall’s opinion is unsatisfactory, Mycall may block the Service, terminate the Agreement and/or refuse to accept orders for subscriptions/services. The Customer is not relieved of his/her payment obligation if the credit limit is exceeded.

5. Personal Identification Data and Loss of SIM Card

Access to the Services may require personal identification data such as username, password, SIM card, eSIM, PIN and PUK codes, or other personal cards or codes. Such identification data and equipment must be stored securely and not made accessible or known to unauthorised persons.

If the Customer loses or has their SIM card stolen (e.g., through theft of a mobile phone) or in case of other suspicion of unauthorised use or access to the Services, this must be reported immediately to Mycall’s Customer Service Centre. Contact information can be found at https://mycall.no/customer-service/contact-us. The Customer is responsible for unauthorised use of services and equipment until Mycall has received the blocking notice. Liability is limited to NOK 1,000. If the blocking notice is given later to Mycall’s Customer Service Centre or if the misuse was made possible by negligence on the part of the Customer, the Customer’s liability is limited to NOK 10,000. The loss limitation does not apply in cases of gross negligence or wilful misconduct by the Customer. If the Customer does not give a blocking notice without undue delay from the time the phone/SIM card/security code was lost, this is considered grossly negligent. See point 9 regarding reactivation fee and payment during the blocking period.

6. Users entitle to use the Subscription

If the Customer has allowed another person to use the subscription, such a User will be able to use the subscription as if the User were the Customer themselves. This means that the User can generate costs for the Customer, for example by calling special numbers, using data roaming, making payments using services such as Strex, purchasing data bundles, ordering third-party services (for example, music streaming service), ordering internal add-on services, changing the subscription, and purchasing extra SIM cards.

Information about the customer relationship given to Users is considered to be communicated to the Customer.

The above applies only if the User is of legal age. Minor Users can also use the subscription in a way that generates costs, but they cannot order third-party services, change the subscription or purchase equipment.

Mycall may set a limit on the number of registered subscriptions per person.

7. Third-party Services

For some subscriptions, ordering of third-party services through Mycall is offered, for example insurance, music, and streaming services. By ordering such third-party services, the Customer also accepts the user terms issued by the third-party provider for use of these. The services are invoiced from the time of ordering, regardless of whether the service is in fact activated with the third party or used by the Customer. If the use of such services generates data traffic on the mobile network in excess of the data included in the Customer’s subscription, the Customer will be charged for this as regular data traffic.

Upon cancellation of the third-party service, access to the service ceases at the end of the paid period. If the Customer’s subscription is terminated, the Customer’s access to the third-party service will cease immediately without any refund, unless otherwise agreed.

8. Use and Security

The Services and equipment received from Mycall must be used in a responsible manner and in accordance with user instructions if available. The Services are for personal use only. The Customer must refrain from any form of misuse as described below in point 9.

The Customer must ensure that equipment used together with the Services is adequately protected against unauthorised access, power surges, and fulfils relevant public regulatory requirements.

9. Suspension or Restriction of the Services

Mycall may implement measures which may result in interruptions, restrictions, disturbances, or loss of data in the Services in cases required by law or order from public authorities. Mycall may also implement such measures when deemed necessary for operational, security, or technical reasons, or if Mycall suspects unauthorised use.

Mycall may close down or restrict access (e.g., reduce speed) to the Services if, in Mycall’s assessment, misuse is likely; for example, when the Customer or User: · fails to meet their payment obligations and does not pay by the deadline specified in the suspension notice, cf. point 14;

· uses the Service in violation of the Agreement, law, public decisions, judgments, etc.;

· misuses or causes disturbances in the communications network or towards others, for example through mass communication (spam), harassment, threats, or by noise caused by faults in technical equipment;

  • interferes with the Service or equipment;
  • infringes Mycall’s or third parties’ rights or causes loss or damage to Mycall or third parties;
  • resells, pledges, lends, leases, or otherwise offers the Service or equipment to third parties;
  • provides incorrect or incomplete customer information;
  • exceeds the credit limit or no longer has a satisfactory credit assessment; or
  • has shared login information for the Services with persons without lawful access to the Services.

Mycall will, as far as is technically possible, only close down or restrict the affected Service and provide prior notice. If necessary, shutdown may occur immediately and without prior warning.

If the Service is closed due to misuse by the Customer or User, or is blocked at the Customer’s request, the Customer may be charged a reactivation fee in accordance with the current price list upon reopening, see point 11. The Customer’s payment obligation for the Service remains during the blocking period, unless the Service has been blocked due to late payment.

Measures that involve deletion of user data and/or user accounts will, where possible, be notified to the Customer via email or SMS, unless the usage or content is of such a nature as to threaten the security of Mycall’s systems. In such situations, Mycall will attempt to enter into dialogue with the Customer to determine the facts and try to find a solution satisfactory for the Customer.

10. Customer’s Duty of Disclosure

The Customer must ensure that Mycall always has up-to-date and complete customer information, including name, address, phone number/email address, as well as other information relevant for Mycall’s provision of the Services or for Mycall’s communication with the Customer and Users. If other persons are to be registered as payer and/or User of the Service, the Customer must also ensure up-to-date and complete information about these. The Customer must notify Mycall without undue delay of changes to such information.

11. Prices and Fees

Unless otherwise agreed in writing, the currently applicable prices, charges and fees as stated at www.mycall.no/mobile-prices apply at all times.

Any included usage is calculated on a monthly basis.

12. Payment Terms

Mycall has the right to invoice the monthly price for subscriptions and add-on services in advance, while consumption exceeding included content is invoiced in arrears. If there are delays in reporting to Mycall, usage may be invoiced at a later date. This particularly applies to use abroad,

data traffic and special services, including content services. Setup fees may be required to be paid before a service is activated.

Billing takes place monthly via AvtaleGiro, eFaktura, invoice by email, paper invoice, debit card, or Vipps. Mycall may charge a fee for invoice delivery.

If the Customer’s subscription includes add-on services free of charge or on a trial period, the Customer will not be charged the fixed price for such services for the specified period that such offers apply. If the Customer does not cancel the add-on service before the end of a specified trial period, the Customer will then be charged the monthly price for the service. The Customer cannot utilise multiple trial periods per add-on service. If the service is invoiced in advance, the invoice for the following payment period may arrive before the trial period has expired.

13. Invoice Complaints

Complaints about invoices should be directed to Mycall’s Customer Service Centre, see point 25 below. The complaint must be made within a reasonable time and if possible before the payment deadline. As long as the complaint is being processed by Mycall, late payment interest and fees will not accrue for the disputed part of the invoice. The Customer must pay the undisputed part of the invoice by the due date.

14. Missing or Late Payment

If the Customer does not pay by the payment deadline, a reminder will be sent with a new payment deadline and notice of Service suspension. If payment is still not made by the new deadline, the Service may be suspended and the Agreement terminated.

In case of delayed or missing payments, Mycall may claim reminder fees, late payment interest and any costs associated with collection in accordance with the Late Payment Interest Act and the Debt Collection Act.

15. Communication and Marketing

Mycall may use any form of communication with the Customer, including electronic communication (SMS, MMS, email, etc.).

To enable the Customer to get the most out of the Services, the Customer will receive offers and useful information from Mycall. The Customer may opt out of marketing from Mycall on https://mycall.no/my-pages, by using the unsubscribe links in marketing communications from Mycall, or by contacting Mycall’s Customer Service Centre. Contact information can be found at https://mycall.no/customer-service/contact-us. The Customer cannot opt out of emails and SMS with information about the Services, as well as invoices and other items necessary for the delivery of the Services.

16. Duty of Confidentiality and Privacy

Mycall shall process customer and user information in accordance with all applicable laws and regulations, including the Personal Data Act, the Electronic Communications Act, the Marketing Control Act and the Accounting Act. This means, among other things, that Mycall is obliged to keep confidential the content of electronic communications and the use of electronic communications. The duty of confidentiality does not prevent information being disclosed to the police and others as provided by law.

Information about Customers and Users is collected and processed by Mycall and by Mycall’s subcontractors so that Mycall can provide the Services to the Customer. The legal basis for this processing is the Agreement. This basis also applies to the information Mycall needs to administer and optimise the customer relationship and ensure security in Mycall’s IT systems, as well as to maintain and further develop the Services. Mycall also compiles information about the Customer’s use of the services in order to offer a better and more relevant user experience. Detailed information about how Mycall handles personal data can be found in Mycall’s current privacy policy, available at https://privacy.mycall.no/.

17. Right of Withdrawal

If the Agreement is entered into by distance selling or sale outside a fixed sales outlet, such as telephone sales, door-to-door sales, or sales over the internet, the Customer has the right to withdraw from the Agreement within 14 days without stating any reason. The period starts on entering into the Agreement unless otherwise agreed.

To exercise the right of withdrawal, the Customer must provide Mycall with a clear notice. This can be done by sending the withdrawal form via the electronic form at www.mycall.no/privacy-and-cookies or by another means.

If the Customer has requested the commencement of the Service before the withdrawal period expires, the Customer must nonetheless pay for usage of the Service up until Mycall was notified of the exercise of the right of withdrawal.

18. Duration and Termination

Unless otherwise agreed, either party may terminate the Agreement or individual Services with one month’s written notice from the end of the month in which the notice was received by the other party. For mobile subscriptions, separate provisions regarding notice periods apply as stated in the service-specific terms for mobile.

Termination by Mycall requires valid grounds.
In case of misuse of the right of termination, e.g., repeated subscription sign-ups and subsequent termination, Mycall has the right to refuse new subscriptions and/or enforce other consequences of breach of contract.

19. Consequences of Ordinary Termination

At the end of the notice period, the Agreement ends and the Customer’s access to the Services is closed. The Customer shall pay any charges, fees, and costs incurred up until termination.

20. Changes

Mycall has the right to update and make changes to terms, prices, equipment, and services, including discontinuing services, with at least one month’s prior notice.

21. Complaints, Delays, and Defects

The Customer must notify Mycall’s Customer Service Centre of any claims resulting from delay or defects in the Service, see point 25. Notification must be given within a reasonable time unless otherwise required by non-derogable law. Delays or defects caused by circumstances relating to the Customer, measures required by law or public authority, or obstacles beyond Mycall’s control, are not Mycall’s responsibility and do not give grounds for claims against Mycall.

Mycall shall implement the necessary measures to correct circumstances for which Mycall is responsible. The Customer shall provide Mycall with access to property, equipment, and services necessary for troubleshooting and rectification. If Mycall does not succeed in correcting the defect within a reasonable time, or if the Service is not delivered on time, the Customer may demand reasonable compensation. In some cases, the Customer may demand cancellation and compensation, see point 22 and 24.

If the defect is due to issues with the Customer’s own network, improper use, negligence or other circumstances for which the Customer is responsible, the Customer must pay for transport, service, and repairs in accordance with the current price list, see point 11.

22. Cancellation

Either party may cancel the Agreement in case of material breach of contract by the other party, unless otherwise required by non-derogable law. Material breach by the Customer includes, for example, serious or repeated breaches of contract, use of the Service for purposes other than personal use, misuse of the Service (see point 9), or misuse of the right of termination (see point 18). In the event of cancellation, the Service is immediately closed and without prior notice, and content may be deleted where relevant.

23. Liability for Damages

Mycall is liable for direct losses caused by delay or defects in the Service unless Mycall can demonstrate that the situation is due to circumstances beyond Mycall’s control which Mycall could not reasonably have been expected to consider when entering into the agreement or to avoid or overcome the consequences thereof.

The liability of both parties is limited to NOK 25,000 per individual loss or series of losses arising from the same cause. The parties’ liability does not cover indirect losses, loss of profit, loss of goodwill, losses resulting from destroyed, deleted, lost, or deteriorated data, losses resulting from reduced or discontinued production or turnover, or losses resulting from the Service not being usable as intended. Under no circumstances is Mycall liable for losses relating to the Customer’s or User’s business activities.

The limitations of liability in this section do not apply if the loss/damage was caused by gross negligence or wilful misconduct or if otherwise required by non-derogable law.

24. Transfer/Change of Ownership

If the Agreement is to be transferred to another person (change of ownership), this requires Mycall's written consent. Consent will not be unreasonably withheld. Before a change of ownership can take place, all outstanding obligations must be paid. Mycall may require unequivocal identification and written consent from both the existing and new Customer. Upon transfer, Mycall reserves the right to invoice the current setup fee as for a new subscription, see point 11.

Mycall is free to transfer the Agreement provided that the acquiring company will comply with statutory requirements for offering the relevant Services.

25. Complaints, Complaint Handling and Other Enquiries

Any complaints should be directed to Mycall's Customer Service Centre. Contact information is available at https://mycall.no/customer-service/contact-us. Complaints that are rejected may be brought before the Norwegian Complaints Board for Electronic Communication (BKN) in cases covered by the scheme. See brukerklagenemnda.no for more information.

26. Governing Law and Jurisdiction

The Agreement is governed by Norwegian law. Disputes shall be resolved by the Oslo District Court, unless otherwise required by non-derogable law.

27. Entry into Force

These service-specific terms apply from 1 May 2025 and replace all previous general terms for Mycall's services for private individuals.

SERVICE-SPECIFIC TERMS FOR MOBILE SERVICES

SUBSCRIPTION TERMS FOR MYCALL, A PART OF TELIA NORGE AS (ORG.NO. 981 929 055). EFFECTIVE FROM 01/05/2025

1. General

These service-specific terms apply to mobile services, including mobile broadband, from Mycall and apply in addition to Mycall’s general terms for private customers, which are available at www.mycall.no/privacy-and-cookies. In the event of conflict, these service-specific terms take precedence over the general subscription terms.

2. Mycall's Mobile Services

2.1. General

Mycall’s mobile services give the Customer access to use call minutes, SMS, MMS and/or data traffic in Mycall’s mobile network in Norway. For use in or to other countries, see point 5. Some subscriptions also provide access to other services. See what is included, prices, and what restrictions apply for the various mobile subscriptions at www.mycall.no/mobile-prices.

2.2. Ongoing subscription

An ongoing subscription includes a specified amount of call minutes, SMS, MMS and/or data traffic per billing period, and any usage exceeding the included units will be charged according to prices specified at www.mycall.no/mobile-prices. At the end of each billing period or if the subscription is cancelled, the remaining balance will be forfeited.

2.3. Prepaid card

Purchasing a prepaid card gives the Customer the right to use mobile services provided that the Customer has a sufficient amount on the prepaid card balance or has pre-purchased packages that cover the intended usage. When changing a prepaid card to an ongoing subscription, the remaining money balance is credited on the invoice, but not paid out. The remaining balance is also not paid out in the event of transfer, termination, or expiry of the prepaid card’s validity. In the event of changing provider, point 8 below applies.

In the case of porting, Mycall will, at the Customer's request, refund any remaining balance to consumers who have prepaid for the Service using a prepaid card, less the costs associated with the refund. Requests for a refund must be made within 5 months after termination.

2.4. What is meant by free or unlimited use

For subscriptions that include free use of call minutes, SMS and MMS, usage is limited up to 20,000 call minutes, 20,000 SMS, and 20,000 MMS per billing period for ongoing subscriptions or per the duration of the package for prepaid subscriptions. For subscriptions that include unlimited data use, the speed of the subscription (upload and download) will be reduced when a specified traffic volume per billing period has been consumed.

2.5. Traffic to special numbers, abroad, etc.

Traffic to/from special numbers, short numbers, directory enquiry services, abroad, boat/ferry/ship, call forwarding and SMS/MMS delivery reports are not included and will be charged to the customer according to prices as stated at www.mycall.no/mobile-prices.

2.6. Upgrading and downgrading ongoing subscriptions

When upgrading a subscription, unused call minutes, SMS/MMS, and/or data will be transferred to the new subscription until the accumulated amount equals the included volume for the new subscription. In the case of downgrading, unused call minutes, SMS/MMS, and/or data may be forfeited.

3. Special Conditions for Use of Mobile Data

3.1. Data speed

The experienced speed depends on the type of subscription, device, coverage conditions, signal strength, distance from the transmitter, and how many people use the same base station, as well as the time of day. For information about speed, expected speed, and coverage, see www.mycall.no/customer-service/coverage-and-speed.

3.2. Data traffic volume

Subscriptions that have a specified data traffic volume included per month will have their data transfer speed limited or blocked when the stated traffic volume, accrued Data Rollover, and extra data packages are consumed (uploading and downloading). The included data traffic volume is stated at www.mycall.no/mobile-prices.

3.3. Data Rollover

Customers who have Data Rollover included in their subscription can have data not used up by the end of a billing period carried over to the next billing period. The maximum possible accumulated data amount is equal to the included data traffic volume for the subscription. Time-limited extra data packages or fixed data packages are not counted towards the maximum limit for accumulated data in Data Rollover.

3.4. Specialised services and traffic management

Specialised services will be prioritised over other data traffic. The customer can choose whether or not to use the specialised service. A specialised service is a service with special quality requirements, for example because it is time-critical. One example of a specialised service is 4G Voice. In practice, this means that if you make calls over the 4G network, this will consume available network data capacity. 4G Voice will therefore be prioritised over other data traffic.

Mycall may use traffic management for security purposes, to maintain agreed-upon service limitations, and to block services, content and applications for legal reasons or following orders from public authorities.

Mycall also uses traffic management as a tool to ensure high quality of services. When there is a lot of traffic, certain types of traffic may be prioritised to ensure seamless and uninterrupted internet access. Alternatively, in the event of congestion, the speed of certain types of non-critical traffic may be reduced. For more information, see mycall.no/dekning.

3.5 About subscriptions with free or unlimited data use

For subscriptions that allow free or unlimited data use, Mycall may set an upper limit for free-of-charge data quota use in the EU/EEA and the United Kingdom, and invoice a surcharge for usage exceeding this limit. The limit and surcharge shall be calculated in accordance with the EU's Fair Usage Policy (FUP) guidelines. Mycall will notify the User by SMS before the limit is reached.

4. Use in and to foreign countries

Abroad, traffic is routed through the foreign mobile operators’ networks. Mycall is not responsible for coverage, quality, security, service offerings, etc., in foreign mobile networks, unless otherwise required by mandatory law.

Use in and to other countries is invoiced in accordance with the then-current price lists for international roaming and international traffic. Prices depend on the country and type of subscription. The customer must check the current prices themselves at www.mycall.no/mobile-prices/from-abroad.

Subscriptions that can be used abroad entitle the Customer, when temporarily staying in the EU/EEA, Switzerland, and the United Kingdom, to use their mobile subscription in communication networks in these countries on the same terms as in Norway (“Roam Like Home”). Roam Like Home does not apply to special numbers, call forwarding, traffic from a ferry, plane or offshore, or calls from Norway to the EU, EEA, Switzerland or the United Kingdom.

Certain mobile subscriptions with Mycall also include minutes to foreign countries; information about this can be found at www.mycall.no/mobilabonnement.

5. Directory Enquiry Services

Unless the Customer has opted out, Mycall will provide information about the Customer such as name, address, number, etc., to directory enquiry services. The customer may opt out of such services at no charge via My Page or by contacting Mycall Customer Service.

6. Termination and Number Portability

The customer may terminate the Agreement at any time. Unless otherwise stated in the notice of termination, the Agreement terminates the day after the notice is received by Mycall. Notice of termination must be provided in writing. The customer is obliged to pay all accrued charges through the current billing period and will receive a final invoice after termination. The customer retains the right to port the number associated with the Agreement to another provider for one month after termination.

Porting out a telephone number is considered termination of the Agreement with Mycall, and the Customer is obliged to pay all fees until the end of the current billing period. All relevant provisions of the Agreement apply until outstanding amounts are paid.

Number porting to Mycall usually takes up to 10 working days from when the Customer requests this, unless special circumstances apply. Porting in entails that the Customer enters into a new subscription agreement with Mycall. The customer is responsible for settling accounts with the previous provider.

Mycall may withdraw a number under the Customer’s control if there is special reason.

If there has been no outgoing traffic (calls, SMS, MMS, data traffic) or top-up for the last 9 months, Mycall may terminate the subscription.

In the event of a death, Mycall may request a copy of the death certificate or probate grant before the subscription is cancelled.

7. Joint invoiced services via Strex

Strex is a payment solution provided by Strex AS which the Customer can use to pay for purchases of goods and services, including voice services to special numbers (value-added services), from approved merchants by charging their mobile bill. By logging in to strex.no, the Customer can at any time get a full overview of all purchases charged to the mobile bill. Inquiries to Mycall from Customers regarding purchases charged to the mobile bill may be referred by Mycall to Strex and to the information available at strex.no.

The Customer can block access to joint invoiced services through My Page or by contacting Mycall Customer Service. Contact information is available at https://mycall.no/customer-service/contact-us. The Customer can similarly block the use of Strex above a certain amount per month, minimum NOK 100, or for a predefined selection of numbers. The Customer will be informed when a self-defined spending limit or the maximum limit per transaction/month is reached. Mycall will then block further use of Strex. For more information about maximum limits or joint invoiced services in general, see www.mycall.no/mobile-prices

Complaints regarding transactions via Strex may be directed to Mycall, directly to the seller/service provider or to Strex. In the event of a dispute, the Customer may refer the complaint to the User Complaints Board, provided the matter falls within its scope.

8. Entry Into Force

These service-specific terms are effective from 1 May 2025 and replace all previous service-specific terms for mobile services for private individuals.

1. General

These terms and conditions apply to the purchase of goods made by consumers in Telia's online shop for customers of Mycall, part of Telia Norge AS, reg. no. 981 929 055 (hereinafter referred to as Mycall).

Only individuals with an active mobile subscription with Mycall may purchase goods from Telia's online shop.

The general terms and service-specific terms for private customers apply in addition to these terms insofar as they are relevant.

Consumer purchases over the internet are mainly governed by the Contracts Act, Consumer Purchases Act, Marketing Act, Right of Withdrawal Act, and E-Commerce Act, and these laws provide the consumer with non-waivable rights. The laws are available at www.lovdata.no. The terms and conditions in this agreement should not be understood as a limitation of the statutory rights, but rather outline the parties' most important rights and obligations regarding the transaction.

2. Prices and Reservations

The applicable prices for the goods are stated on mycall.no, and all prices include VAT. Delivery costs related to the shipment will be added.

The agreement becomes binding for both parties once Mycall has received the customer's order. Upon receipt of the order, the customer will receive an order confirmation to the email address provided. Please read the order confirmation carefully when you receive it, and check that the order confirmation matches your order. If you discover any errors in the order confirmation, you should contact Mycall as soon as possible.

Mycall endeavours to provide customers with accurate information about the goods. However, mistakes may occur. Mycall will not be bound by the order if there has been a typographical or clerical error in Mycall's offer in the ordering system on the website, in the customer's order or in advertisements, and the customer realised or should have realised that such an error had occurred.

Furthermore, Mycall reserves the right to cancel the order or part of it if the product is out of stock. In such a situation, the customer will be notified that the item is out of stock, possibly together with information regarding a replacement item. The customer will have the opportunity to accept the new offer with the changes specified compared to the original order, or to cancel the order.

3. Payment

In Mycall's online shop, the customer may choose among the payment methods offered, including payment through our partner Klarna.

When choosing instalment/credit purchase via Klarna, Klarna’s terms for credit purchases will apply, available here: Credit Agreement | Klarna Norge. If payment is not made, the claim will be sent to debt collection in accordance with applicable regulations.

4. Delivery Terms

Mycall offers delivery options based on the customer's address. Some delivery options may incur a fee.

Normal delivery time is 1–3 working days, provided the item is in stock when ordered. Delivery times may vary depending on where you live in the country. When ordering, you will receive a tracking number you can use to follow your delivery.

If the item is not collected in time, it will be returned to us, and you will be refunded the purchase amount, with no fee.

5. Return Policy and Right of Withdrawal

The customer may cancel the purchase of the item in accordance with the Right of Withdrawal Act.

The customer must notify Telia of the use of the right of withdrawal within 14 days from the day after the item(s) are received. If the purchase consists of several deliveries, the right of withdrawal counts from the day after the last delivery is received. The buyer bears the burden of proof that the right of withdrawal has been exercised, so notification should preferably be given in writing. A standard withdrawal form will be sent together with the order confirmation.

When exercising the right of withdrawal, the item must be returned to the seller without undue delay and no later than 14 days after notice of withdrawal has been given.

If testing or trial of the product during the withdrawal period exceeds what is reasonable and necessary, you may be held liable for any diminished value of the product. The product should, if possible, be returned in its original packaging.

The right of withdrawal does not apply to goods that deteriorate quickly and goods which, by their nature, cannot be returned. Items sealed for hygiene reasons (e.g. earplugs/in-ear headphones) cannot be returned if the seal has been broken after delivery.

The buyer covers the direct costs of returning the goods unless otherwise agreed.

In the case of returns, Mycall will refund the purchase amount without undue delay and no later than 14 days after Mycall has received the item or documentation showing that the items have been returned.

6. Use of the Goods

The customer is expected to thoroughly familiarise themselves with the product description provided in the manuals and user guides supplied with the product, as well as the instructions for use given therein. Mycall shall not be liable for faults or defects in the product resulting from incorrect use, storage, or similar.

7. Faults or Defects

In the event of faults or defects, the customer must notify Mycall within a reasonable time after the fault or defect is discovered. Such notification should be provided in writing.

If the product is defective and this is not due to the buyer or circumstances on the buyer's side, the buyer may, in accordance with the rules of Chapter 6 of the Consumer Purchases Act, withhold payment, choose between repair and replacement, demand a price reduction, terminate the agreement and/or claim compensation from the seller, depending on the circumstances.

8. Dispute Resolution

Complaints should be addressed to Mycall within a reasonable time, see section 7. The parties should attempt to resolve any disputes amicably.

If the complaint does not result in an amicable solution between the parties, the customer can contact the Consumer Authority for mediation, see www.forbrukertilsynet.no. The European Commission's complaints portal can also be used if you wish to file a complaint. This is particularly relevant if you are a consumer residing in another EU country. Complaints can be submitted here: http://ec.europa.eu/odr.

How Referrals Work

Referral works by you, as an existing Mycall customer (the referrer), sending an invitation to friends and family (the referees) via the Mycall app. Log in to the Mycall app and send an SMS invitation directly from your contact list. The link is unique to you as a customer.

When your friend orders a mobile subscription via your link and activates it, you both receive 500 MyPoints, equivalent to £500 in value.

The Referral Reward

For each friend you refer, both you and your friend receive 500 MyPoints. In addition, you get a bonus for every fifth friend you refer. The bonus can be activated in the app.

MyPoints can be used to pay your monthly subscription fee, buy extra data packages, international calling packages, as well as mobile phones and other products from the Mycall online shop.

MyPoints cannot be converted into currency and cannot be withdrawn as cash or transferred to a bank account.

FAQ

What is Mycall’s referral programme? Mycall’s referral programme allows you to invite friends and family to become Mycall customers. When they join, both you and the person you refer receive 500 MyPoints.

Who can refer? All active Mycall customers can refer others.

How do I refer? Open the Mycall app, go to MyDeals and select MyFriends. Choose who you want to invite from your contact list and send them an SMS invitation.

How do you get referred? You receive an SMS link from an existing Mycall customer. If you order a mobile subscription via the link and activate it, you both receive 500 MyPoints.

What are MyPoints? MyPoints are bonus points you earn by referring friends. 1 MyPoint = £1, so 500 MyPoints are worth £500.

What can I use MyPoints for? You can use MyPoints to pay your monthly subscription fee, buy extra data packages, international calling packages, and products from the Mycall online shop.

Can I refer the same person more than once? No. The same person or mobile number can only be referred once in a 12-month period.

Can I refer my own number? No. You cannot refer yourself or numbers that you own.

Do MyPoints expire? Yes, MyPoints expire 36 months after they are earned. If you end your customer relationship, you lose any points you have earned. If you become a customer again, your points start from scratch.

Can MyPoints be paid out as money? No. MyPoints cannot be withdrawn as cash or transferred to a bank account.

Formal Terms

The customer (the referrer): You must be an active Mycall customer to refer. You and the person you refer each receive 500 MyPoints once the subscription is activated. You cannot refer yourself or your own numbers. The same person or number can only be referred once in a 12-month period. For every fifth friend you refer, you receive a bonus that can be activated in the app.

The referee: You must order a mobile subscription via the referral link and activate it for both parties to receive MyPoints. You (your number) must not have previously benefited from the referral offer in the last 12 months.

General: Yes, MyPoints expire 36 months after earning. Mycall reserves the right to change the value of MyPoints, the terms, or to end the programme. Changes will be announced in the app or on the website. Mycall reserves the right to withdraw referral rewards in the event of obvious misuse, for example by creating fictitious customer relationships.

Mycall’s Processing of Personal Data

Mycall offers telecommunications services, including mobile telephony (prepaid and subscription).

In its operations, Mycall processes personal data about its customers, including information such as name, telephone number, address, National Identity Number, subscriptions, traffic data, as well as other information necessary to provide its services. The personal data is primarily obtained directly from the customer.

The purpose of Mycall’s processing of personal data is to fulfil the contractual relationship with the customer, including delivering the services, invoicing, and providing the best possible service. Customer personal data will only be processed for as long and to the extent necessary to achieve these purposes. Mycall will also use the information as a basis for distributing information to the customer about Mycall’s services and other necessary information related to the contractual relationship. Mycall may also send such information via electronic communication, in accordance with Section 2 b of the Marketing Act.

When subscribing to a postpaid mobile or broadband telephony subscription, Mycall also carries out a credit assessment of the customer and, in this regard, obtains credit information from credit reference agencies. The credit information is used only in connection with the subscription process and is not stored by Mycall.

Mycall uses data processors, partners, and suppliers to be able to provide customers with telecommunications services. To the extent necessary for fulfilling the agreement with the customer, such third parties will have access to customers’ personal data. If Mycall assigns the processing of personal data to third parties, this is done under a separate agreement with them, which ensures the protection of customer privacy. Disclosure of personal data will also take place if required by law or as part of payment collection (debt collection) and accounting processes.

Under the Electronic Communications Act, Mycall is obliged to maintain confidentiality about the content of electronic communication and others’ use of electronic communication, including information about technical devices and procedures. Disclosure of such information will only be made to data processors who have a legitimate need for it to process personal data on behalf of Mycall, and subject to a duty of confidentiality. Courts, prosecuting authorities, and other public authorities may nevertheless obtain such information in cases where this is authorised by law.

All telecommunications operators are legally required to provide customers’ names, addresses, and telephone numbers to directory and number information services unless the customer has opted out of such disclosure. If the customer wishes to opt out, customer service must be contacted.

The customer is entitled to request access to the personal data Mycall has registered and the type of processing these are subject to. If the information registered about the customer is incorrect or incomplete, it can be corrected via "My Page" on the internet. Furthermore, the customer can request that incorrect or incomplete information be corrected, supplemented, or deleted by contacting Mycall’s customer service.

Mycall deletes personal data when there is no longer a need for processing and in accordance with the requirements of the applicable regulations at any given time. If an invoice has not been paid, or if there is a legal dispute about the payment obligation, Mycall may retain traffic data until the claim has been settled or legally resolved. Once the invoice is paid, Mycall may store the total amount in addition to the name and address of the customer.

Mycall is the data controller for the processing of personal data as described here. Mycall’s business address is Sandakerveien 140, 0484 Oslo.

It is voluntary to give consent for Mycall’s processing of personal data, and the customer can withdraw consent at any time. However, such withdrawal may mean that Mycall will no longer be able to provide the agreed services and products to the customer, and may therefore result in the termination of the customer relationship.

Basis of the Agreement

The insurance consists of the insurance certificate and insurance terms which are mediated by Mycall. Unless otherwise agreed, Norwegian law applies. It is the Act of 16 June 1989 no. 69 on Insurance Agreements (the Insurance Contracts Act) that regulates agreements on property insurance and personal insurance.

About the Agreement

When you take out a subscription with Mycall, NetSafe provided by Tryg is included. The applicable terms, as well as other significant information about the insurance, will always be available on Mycall's website. The insurance agreement includes the insurance certificate with specified insurance coverage, specifications, any special terms, and the insurance terms.

With NetSafe you receive advice on how to avoid personal information being spread online. In addition, you receive help and guidance to remove content that is unlawful and offensive, as well as to close down fake profiles created in your name. Usually, it will be sufficient to remove the unwanted content from the internet. There are a number of specific measures that can be taken to remove content from the internet. Truesec are specialists in this area, and are Tryg Forsikring’s provider of such services. In some cases, however, legal assistance may also be necessary. Tryg's partner for legal assistance is Advokatfirmaet Legalis. 

NetSafe is only included with subscriptions and does not apply to pay-as-you-go solutions.

1. Who the insurance applies to

Registered users who have an active monthly Mycall subscription paid by bank card (does not apply to pay-as-you-go, shop-purchased packages, data packages or one-off packages). The insured must be registered in the National Population Register with a permanent residential address in Norway. 

2. Where the insurance applies

The insurance is valid worldwide. Claims handling and payment of compensation is only carried out in Norway, regardless of where in the world the insured is located at the time of the incident.

3. What is covered by the insurance 

The insurance applies when the insured is subjected to illegal and offensive content in the form of text, images, audio, video, and other material that is published on the internet in violation of the Penal Code or data protection legislation (GDPR). 

By illegal and offensive content is meant content that is contrary to the following legislation:

  • §267 b. Gross sharing of offensive images, etc.
  • §263. Threats

4. Duration of the insurance 

The insurance is valid from the time it is registered with Mycall and is renewed automatically monthly as long as the subscription is active. The insurance is valid until payment ceases, the insurance is terminated, or the subscription ends. For an incident to be covered by the insurance, the event must have occurred and been established during the insurance period.  

5. What is the excess

There is no excess for this insurance. 

6. Compensation provisions

6.1 Advisory and assistance from Truesec

a) Advice on how the insured can protect themselves against unwanted personal information being spread on the internet. 

b) Help to remove unwanted content from the internet. This can, for example, include: 

  • unwanted images and videos
  • offensive comments and threats
  • bullying and other harassing material
  • personal information
  • contact details
  • regaining control of hacked user accounts and email accounts. Help to close down fake profiles created in your name. 

It is a requirement that the content is unlawful, cf. point 3, or in breach of the applicable guidelines for the relevant websites. 

6.2 Legal assistance 

If an incident covered under point 3 has occurred, and Truesec has taken steps to remove illegal and offensive content, the insurance also covers reasonable and necessary legal assistance. 

6.2.1 Choice of lawyer 

Tryg's partner is Advokatfirmaet Legalis. If the insured chooses to use Legalis, Tryg will cover all reasonable and necessary expenses. Legalis invoices Tryg directly. 

If using another provider of legal services, Tryg will refund the insured's reasonable and necessary expenses, limited to the hourly rate equivalent to the public fee rate. 

Legal assistance only applies to cases governed by Norwegian law and with Norwegian courts as the legal venue. 

6.3 Lost earnings

The insurance covers loss of earnings which are a direct result of necessary absence from work to undertake the necessary errands to remove unwanted or offensive content from the internet, as well as to close fake profiles created in your name, if the content is covered under point 3.

The compensation basis is determined according to the documented financial loss in the form of confirmation from an employer, payslip or other documentation confirming the amount of lost earnings for the insured.

Tryg has the right to include the paid amount for lost earnings in any compensation claim made on behalf of the insured against a violating party/counterparty. The proportion of the compensation amount related to payment made by the company accrues to the company if a counterparty subsequently pays compensation to the insured.

6.4 Psychological assistance

The right to reimbursement of expenses for crisis therapy up to 5,000 NOK, when the insured is subjected to the spread of illegal and offensive content on the internet or other digital platforms. 

Travel expenses in connection with treatment are covered according to the National Insurance scheme's rates. 

Treatment is carried out by a psychologist in agreement with the company.

6.5 The insurance does not cover

a) Incidents arising as a result of the insured's immediate family's* criminal or grossly negligent actions.
b) Actions carried out by the insured's immediate family*. 
c) Loss of income for self-employed persons.
d) Loss of earnings in cases where, according to law or agreement, it can be claimed from the insured’s employer. 
e) Travel costs abroad. 
f)  Therapy beyond 12 months from the date of injury.

*Immediate family means spouse, cohabitant, partner, children or parents.

7. Safety Regulations 

Safety regulations are rules for how the insured or others should act to prevent and limit damage. See the Insurance Contracts Act section 1-2 (e). Tryg reserves the right to be wholly or partially without liability if a safety regulation is breached. Whether the compensation shall be reduced/waived is determined based on the degree of fault, the course of the damage, and the circumstances otherwise. See the Insurance Contracts Act sections 4-8 and 13-9. 

8. In the event of damage

8.1 Reporting damage

In the event of damage, you must report the damage to our Claims Centre without undue delay. You must, in connection with the damage report, provide Tryg with all necessary information, such as a detailed description of what caused the damage. 

When you contact us, you should have the insurance certificate available, as you will need to provide your phone number in connection with reporting the damage. Regarding limitation, see section 12.14.

8.3 Limiting or averting damage

  • As soon as possible, you must avert or limit the damage. 
  • It is a requirement that you actively participate in the work to avert or limit the damage. We may take measures for the same purpose. 
  • If you intentionally or through gross negligence neglect your opportunity to limit the damage and this is to Tryg’s detriment, compensation may be reduced or lapse entirely.

8.4 Payment of compensation

Compensation is paid to the insured as stated in the insurance certificate and to the account specified by them. The insured must be the account holder of the specified account. 

8.5 Police report

The insured must report the matter to the police and provide the company with confirmation that the matter has been reported. The insured may also ask the company for assistance in reporting the matter. 

10. Termination and Communication

10.1 The insurance runs from the time of conclusion and ceases if the insured’s Mycall subscription is no longer valid.

10.2 Tryg reserves the right to terminate the insurance if fraud is involved in relation to the claim. The notice period is then 1 week. See the Insurance Contracts Act sections 8-1 and 18-1. 

10.3 If the insured has grossly breached obligations towards Tryg or if there are other special reasons, the insurance can be cancelled. The notice of termination will be valid 14 days after the date we have sent written notice to you about the cancellation.

10.4 If there is a breach of safety regulations or other conditions limiting liability and cancellation is reasonable. The notice period is then 2 months. See the Insurance Contracts Act sections 3-7 and 12-4.

10.5 If the claim frequency is abnormally high or the course of claims differs from the normal, and cancellation is reasonable. The notice period is then 2 months. See the Insurance Contracts Act sections 3-7 and 12-4.

10.6 Changes to the insurance terms can be made with 2 months' notice.

10.7 Tryg has the right to use electronic communication for sending information (notifications, messages, alerts, etc.) to the insured in connection with the insurance agreement.

11. Exclusions and Limitations

11.1 Extraordinary events

Tryg does not cover under any circumstances damage or loss, or an increase in damage or loss, that directly or indirectly arises from or is connected with:

  • spread of biological or chemical substances
  • use of rockets
  • nuclear weapons
  • radioactive radiation
  • nuclear reactions, ionising radiation, nuclear fuel or radioactive waste
  • radioactive, toxic, explosive or other dangerous properties of nuclear-charged explosive devices
  • war or warlike acts, riots or similar disturbances of public order. However, Tryg covers war risk abroad when the insured is in an area where war or serious unrest breaks out. This only applies when the area was considered peaceful before departure. Cover for war risk is limited to one month.
  • earthquakes or volcanic eruptions
  • pandemic, epidemic
  • flood from sea, fjord, lake, waterways.
  • strike, lockout, arrest, bankruptcy.
  • claims arising as a direct or indirect result of seizure or other intervention carried out by a public authority.

11.2 Sanctions

Tryg cannot provide cover or pay out compensation or other benefits if this would result in Tryg acting in breach of or exposing Tryg to prohibitions, restrictions or sanctions adopted by United Nations bodies. The same applies to trade or economic sanctions, laws or directives passed by the EU, the United Kingdom, or the USA. This limitation cannot be deviated from by agreement.

11.3 Acts of terrorism

The insurance does not cover damage that is a direct or indirect consequence of the spreading of biological, chemical or nuclear materials in connection with acts of terrorism. Terrorism means violence, most often against innocents, carried out by individuals, groups or networks to force through political change or create awareness about a political or religious message, or state terrorism, understood as violence perpetrated by states against their own people or peoples of other countries to maintain a regime of power and/or send a political message to a third party or to influence the public with fear.

12. General Terms

12.1 Other Agreements or Guarantees

The insurance does not cover damage for which another provider or person is responsible by law, guarantee or similar. The insurance is valid, however, if you can show that the party responsible cannot fulfil the obligation.

12.2 Other Insurance

If another insurance policy has been taken out that covers the same risk, the insured may choose which insurance to use until the total compensation entitlement has been received.

12.3 Double Insurance 

If several are responsible for the insured’s damage, Tryg takes over the insured’s right to compensation for the compensation the insured has received from Tryg. If there are several insurances covering the same loss/damage, the insured can choose which insurance company to use until the insured’s total loss has been compensated. The compensation is distributed proportionally among the companies according to the scope of Tryg’s liability for the loss, see the Insurance Contracts Act section 6-3.

12.4 Change of risk - lapse of liability 

Tryg reserves the right to be free of liability for insured events that arise due to a specific change of significant importance for the risk. See Insurance Contracts Act sections 4-6 and 13-6. 

12.5 Renewal of the insurance

The insurance is renewed when you pay your subscription to Mycall.

12.6 Intentional and grossly negligent acts

  • If the insured intentionally caused the insured event, Tryg is not liable. 
  • If the insured caused the insured event by gross negligence, Tryg’s liability may be reduced or lapse entirely. 
  • The rule regarding gross negligence does not apply to children under 16 years.
  • The exception for intentional and grossly negligent actions does not apply if the insured due to age or mental condition could not understand the consequences of their actions.

12.7 Insurance Contracts Act 

For this insurance, the Insurance Contracts Act and the Personal Data Act also apply. The insurance agreement is subject to Norwegian law.

12.9 FOSS

We have, if desired, the right to register all claims reported in connection with this insurance in the insurers’ central claims register, FOSS. The register is used only in connection with claims settlement.

12.10 Guarantee Scheme for Non-Life Insurance

Tryg is a member of the guarantee scheme for non-life insurance in Norway. The guarantee scheme shall not cover more than 90 percent of each claim. Claims under insurance that concerns residential property and compulsory liability insurance shall nevertheless be covered at 100 percent. The guarantee scheme shall not cover insurance claims exceeding 20 million kroner for each claim for each insured for each event. Note in particular that certain types of insurance agreements are not covered by the scheme, including life insurance. For further information about the guarantee scheme, see the regulations on financial enterprises and financial groups of 09.12.2016 (FOR-2016-12-09-1502).

12.11 Identification – effect of others’ actions 

Identification means that acts and omissions by others have the same effect for the insured’s rights as if they were performed by the insured themselves. See Insurance Contracts Act § 4-11. Those who are identified with the insured are spouses living with the insured or persons with whom the insured lives in a stable relationship.

12.12 Contact information

It is the insured’s responsibility to provide correct contact information. The insured agrees that communication may take place via the contact details the insured has agreed to provide at the time of registration; email, phone, text message or letter.

12.13 Governing law and jurisdiction

Norwegian law applies to the insurance agreement to the extent that this is not contrary to the Act of 27 November 1992 no. 111 on choice of law in insurance, or another agreement has been made. Disputes under the insurance agreement are decided by Norwegian courts, unless this contravenes mandatory provisions in applicable law, or another agreement has been made.

12.14 Notification deadlines and limitation

The insured loses the right to compensation if the claim is not reported to Tryg within 1 year after the insured became aware of the circumstances justifying it, cf. Insurance Contracts Act sections 8-5 and 18-5. The insured’s claim against Tryg is time-barred after three years. The period runs from the end of the calendar year in which the insured gained or should have obtained sufficient knowledge of the circumstances justifying the claim. The claim becomes time-barred no later than 10 years after the end of the calendar year in which the insured event occurred. See Insurance Contracts Act § 8-6. If Tryg rejects a claim for compensation, wholly or partly, the insured loses the right to compensation if a lawsuit is not started, or

arbitration is not demanded under Insurance Contracts Act § 8-5 within 6 months after the insured received written notice of the rejection.

12.15 Premium and payment of premium

Premiums are agreed between Tryg and Mycall and set according to Tryg’s tariff. The insurance premium is paid to Mycall as part of the subscription. Your insurance is renewed when you pay your Mycall subscription invoice. Tryg has the right to terminate the insurance in cases where the insurance premium is not paid to Tryg by Mycall.

12.16 Premium adjustment

Tryg has the right to adjust the insurance premium in connection with renewal of the insurance. In such cases, the insured will be informed before the new price takes effect. 

12.17 Reimbursement

If Tryg has paid compensation for a loss/damage that is not covered by the insurance agreement, the insured or those identified with the insured are obliged to repay the compensation. 

12.18 Interest

The insured is entitled to interest in accordance with the Insurance Contracts Act sections 8-4 and 18-4. Tryg calculates interest on the compensation when two months have passed after notification of the insurance event has been sent to Tryg. If the insured fails to provide information or submit documents in accordance with Insurance Contracts Act sections 8-1 and 18-1, they cannot claim interest for the time lost thereby. The same applies if the insured unjustifiably rejects a full or partial settlement.

12.19 Supervision

Trygg-Hansa (Tryg) is supervised by Finanstilsynet in Denmark and Finansinspektionen in Sweden.

12.20 Currency

Unless otherwise stated in the terms or insurance certificate, all amounts are in Norwegian kroner (NOK). This applies to prices, sums insured, compensation amounts and any other amounts derived from the insurance agreement.

12.21 Prohibition of enrichment

The insurance is not intended to result in profit. Tryg replaces, within the insurance agreement, the loss suffered. The size of the sum insured is not decisive for the value of the interest.

13. Summary of personal data policy

Personal data about the insured is processed in accordance with the EU General Data Protection Regulation and supplementary Norwegian data protection legislation. The personal data processed includes, for example, name, address, national identification number, payment information, other information the insurance company needs for arranging insurance, renewal or modification of insurance or other insurance administration, as well as information provided in connection with claims handling etc. Data may be provided for the above purposes to partners within and outside the EU and EEA, insurance intermediaries or other companies in the group.

Trygg-Hansa is the data controller. The insured has the right to know how we process the data and to receive an extract about this (register extract). The insured also has the right to have incorrect information rectified or deleted in certain cases. The insured can also request to restrict processing or object to the processing of the data, and to request that the information the insured has provided to us is transferred to others (so-called data portability). 

The insured can contact us by writing to dpo@trygghansa.se. By contacting us, the insured can also request the privacy policy to be sent by post, and notify us that personal data should not be used for direct marketing.

14. Guidance on complaints

At Tryg, we work to ensure that our claims handling is of high quality and that our decisions are in line with the terms and practice. However, if you do not agree with our decision in connection with a claim, the insured is welcome to send us a written enquiry explaining what you are not satisfied with.

  • You will receive a reassessment most quickly by contacting the department that handled your insurance case. In the enquiry, it is important that you clearly state what you disagree with, and any new information relevant to the case. 
  • If you are still not satisfied with the decision after contacting the department, you can address your complaint to the Quality Department at Tryg. Complaints can be made electronically at: www.tryg.no/meld-skade/klagemuligheter or by letter to: Tryg Forsikring, v/Kvalitetsavdelingen, Postboks 7070, 5020 Bergen.
  • You also have the opportunity to have complaints and disputes regarding the insurance considered by the Financial Complaints Board, see www.finkn.no or Finansklagenemnda, Postboks 53 Skøyen, 0212 Oslo.
  • It is also possible to have your rights under the insurance terms assessed by bringing the matter before the courts. See the Insurance Contracts Act § 20-1.

This insurance certificate contains information about who the insurance applies to, when and where it is valid, as well as the applicable insured amounts. You will also find safety regulations and rules regarding changes in risk.

Safety regulations refer to rules outlining your responsibilities for preventing damage and loss. Rules regarding changes in risk refer to insurance cases that arise because a particular, material risk factor has changed. Tryg reserves the right to bear no responsibility for such cases. 

In the event of a claim, the insured must report it to Tryg without undue delay. The insurance certificate also contains information on how to report claims and your right to appeal decisions in insurance cases, as well as other important information concerning the insurance. Details of what is covered are set out in the insurance terms.

1. Safety regulations 

The safety regulations are rules on how the insured or others must act to prevent and limit damage. Tryg reserves the right to be wholly or partly free from liability if a safety regulation is breached. If an insurance incident occurs due to a breach of the safety regulations, consideration is given to the degree of negligence, the sequence of damage and other circumstances when deciding if, and to what extent, Tryg will pay compensation. See the Insurance Contracts Act, sections 4-8 and 13-9. 

1.1 Obligations of the insured: 

a) report the matter to the police and provide the company with confirmation of the report. The insured can also ask the company for help in reporting the matter. 
b) provide all available information and documents that may be relevant to the case.
c) follow the advice and guidance given to avoid further damage. 

2. Change in risk – loss of liability 

Tryg reserves the right to be entirely free from liability for insurance cases that arise due to a particular, material risk factor being changed. See the Insurance Contracts Act, sections 4-6 and 13-6. 

3. Intentional and grossly negligent actions 

  • If the insured has intentionally caused the insurance event, Tryg is not liable. 
  • If the insured has caused the insurance event through gross negligence, Tryg’s liability may be reduced or forfeited. 
  • The exception for intentional and grossly negligent acts does not apply if the insured, due to age or mental state, could not understand the consequences of their actions. 
  • The rule on gross negligence does not apply to children under 16 years. 

4. Be prompt in reporting damage 

If an insurance event occurs, the insured or anyone who believes they have a claim against Tryg must notify the company without undue delay. See the Insurance Contracts Act, sections 4-10 (3) and 1311 (1).

All claims reported are registered in the insurance companies’ central claims register (FOSS). When a claim is reported to the register, the company automatically receives an overview of all previously reported claims for the same customer. The insured has the right to access the register in accordance with section 18 of the Personal Data Act.

5. Consent

The customer consents to the company processing their own personal data and personal data belonging to minor users of the subscription. 

If the insured is under 18 years of age, the legal owner of the subscription consents to the company, at the minor’s request, offering legal advice to the minor, establishing dialogue with third parties, and requesting that third parties delete defamatory online publications. 

The company will not, without parental or guardian consent, represent the minor in connection with making compensation claims or legal proceedings.

6. Guidance for complaints

a) If you disagree with our decision in an insurance case, we ask that you first contact the department in Tryg that handled your insurance case. 

b) If you are still not satisfied with the decision after contacting the department, you may appeal to the Quality Department in Tryg. The address for the Quality Department is: Tryg Forsikring, v/Kvalitetsavdelingen, PO Box 7070, 5020 Bergen. Appeals may be submitted electronically at:

d) It is also possible to have your rights under the insurance terms tested by bringing the case before the courts. See the Insurance Contracts Act, section 20-1.

7. Identification – effect of others’ actions 

Identification means that actions taken by others will have the same effect on the insured’s rights as if they were taken by the insured themselves. See the Insurance Contracts Act, section 4-11. 

Those identified with the insured are: 

  • a spouse living with the insured. 
  • persons with whom the insured is living in a stable, established relationship.

8. Double insurance, recourse and repayment

In cases where Tryg pays compensation and the damage/loss is also covered by other insurance or liable parties, Tryg may seek recourse from these. If there are multiple insurances covering the same loss/damage, the insured may choose which insurance provider to use until the insured’s total loss is covered. Compensation is distributed proportionally between the companies according to each company’s share of liability for the loss; see the Insurance Contracts Act, section 6-3. If the company has paid compensation for a loss/damage not covered by the insurance agreement, the insured or those identified with them are obliged to repay the compensation. 

9. Legislation 

Unless otherwise agreed, Norwegian legislation applies. The Act of 16 June 1989 no. 69 on Insurance Contracts (the Insurance Contracts Act) regulates agreements on general insurance and personal insurance.

I. TERMS AND CONDITIONS FOR CREDIT PURCHASE

1. General

These terms and conditions for the credit purchase of a mobile phone (the product) apply in addition to the terms and conditions for the Mobile product area and any other services. Only persons who are legally responsible for an active mobile subscription with Mycall (the customer) may enter into an agreement for the credit purchase of a mobile phone. A credit purchase agreement of up to NOK 22,000 per customer is permitted. In addition, a credit purchase customer may purchase one mobile phone in cash (credit card) per year.

2. Prices

Reservation
Current prices for the product are always available in the web shop. Prices are always stated including VAT. Mycall pays the establishment and administration fees.

Delivery charges related to shipping will be added.

3. Ordering and Delivery

The customer orders the product themselves in the web shop. The product is shipped via the carrier on the first working day after the order is placed. Delivery is estimated at 5-7 days. If the customer fails to collect the package and otherwise remains completely passive, this will not give the supplier any indication as to why the package was not collected. The customer will then not have fulfilled the requirements in accordance with the Right of Withdrawal Act §11 and §13, and thus loses the right to withdraw from the purchase agreement. For uncollected packages, the customer will be charged delivery costs for outbound and return shipping, as well as a fee of NOK 350. This is to cover the supplier's costs in connection with dispatch, depreciation of the product value, and return handling.

4. Right of Withdrawal

The Right of Withdrawal Act grants the customer the right to withdraw from the purchase without stating a reason within 14 days after receiving the mandated information as required by Chapter 3 of the Act (see page 2 of the right of withdrawal form). The period for the right of withdrawal expires no later than three months after the product has been received, or after one year if information about the right of withdrawal has not been provided.

5. Use of the Product

The customer is required to familiarise themselves fully with the more detailed description of the product provided in the manuals and instructions supplied with the product, as well as the instructions for using the product given therein. Mycall is not liable for errors and defects in the product resulting from incorrect use, storage, or similar.

6. Defects or Faults

Contact Mycall immediately upon discovering a defect or fault. Damage to the shipment incurred during transport must be reported immediately to the freight forwarder used, who will handle the compensation case. The customer should also inform Mycall of any transport damage.

8. Complaints – Service and Repair

Service and repair of the product must be carried out by service centres approved by Mycall or other authorised service providers approved for handling warranty cases by the phone manufacturers. Mycall's service partner is Mobylife AS. Mobylife AS performs service and warranty repairs in accordance with current legislation and regulations, and Mycall recommends that Mobylife AS is used where service and repair of the product is required. For service and warranty matters, contact Mycall's customer centre on 967 06 160 or contact our service department directly by telephone on 459 17 777.

9. Retention of Title

Mycall holds a retention of title to the purchased product until it is fully paid, including interest and costs. Until this has occurred, the customer does not have the right to sell, pledge, rent, or lend out the product. Mycall reserves the right to IMEI block purchased products in cases of serious breach/fraud. The document that the customer must sign prior to delivery of the product will specify both the product covered by the security interest and the purchase price secured by the retention of title.
The retention of title also applies to any new products the customer purchases from Mycall, as security for the total amount the customer owes under their credit agreements. The products are identified by the signature on the delivery confirmation. If any form of enforcement is initiated against the customer, including if the customer enters into debt negotiations, goes bankrupt, or is otherwise at risk of losing control over the product, the customer is obliged to immediately notify Mycall in writing of the situation.

10. Licenses, Subscriptions, etc.

The customer is solely responsible for paying subscription fees and any other obligations for products bought from Mycall and financed through Mycall's credit purchase scheme.

II. CREDIT AGREEMENT – Part 1

This promissory note (hereinafter referred to as the credit agreement) consists of:

Part 1: This main section, including the General Credit Terms, see below.

Part 2: Standard European Consumer Credit Information (hereinafter referred to as SEF information)

The credit agreement provides that the customer, hereinafter referred to as the credit customer, may purchase one or more products from Mycall, hereinafter referred to as the credit provider, on credit. The credit amount, together with interest and costs calculated according to the rates applicable at any time during the credit period, is repaid in accordance with the terms of the credit agreement. Mycall is entitled to transfer its rights as credit provider under this credit agreement and its other rights vis-à-vis the credit customer, including its retention of title. The credit assessment carried out at the time of ordering products or subscriptions with Mycall forms the basis for the granting of credit. By confirming the purchase of the product, the credit customer acknowledges that they owe the credit provider the outstanding credit amount at any time, including accrued interest and costs. I/we have, well in advance of confirming the credit agreement and with sufficient time to familiarise myself/ourselves with the information, received the general loan terms and Part 2 SEF information. I/we hereby confirm that the general credit terms and Part 2 SEF information have been read and accepted. Enforcement may happen without court proceedings, cf. Enforcement Act § 7-2, letter a.

General Terms for the Credit Agreement

1. Minimum Purchase and New Credit Purchases

Establishing a credit agreement requires the customer to make a credit purchase totalling at least NOK 1,000. New credit purchases require the customer to have complied with previous credit agreements.

2. Repayment

The credit amount is repaid in equal monthly instalments. In addition to repayments and interest, the credit customer pays the fees specified in Part 2 SEF information section 3. The repayment period is determined by the credit customer upon order.

The credit customer is obliged to pay the indicated amount on the invoice received by the due date; alternately, the credit provider will debit the bank for the amount according to the power of attorney granted (direct debit). Upon termination or other cessation of the credit customer’s mobile subscription during the credit agreement period, the credit provider will send separate invoices for the monthly amounts of the credit agreement for the remainder of the period. The credit customer may, at any time and free of charge, during the credit agreement period, request a repayment schedule. If payment holidays have been agreed, the credit customer may similarly request an overview of the timing and conditions for payment of interest and other credit costs.

3. Interest and Charges

3.1 Nominal and effective interest rates are stated in Part 2 SEF information.

3.2 In the event of late payment, interest on arrears will accrue in accordance with the Act on Interest on Late Payments. However, the default interest rate shall not be lower than the rate applicable to the credit agreement at any given time.

3.3 Fees and charges are stated in Part 2 SEF information. The credit provider may unilaterally increase fees and charges on the same conditions and with the same advance notice as mentioned in sections 3.4 a) and b) below. The credit provider may also unilaterally increase fees and charges when the change is reasonably justified by a change in the credit provider’s costs or a restructuring of the provider’s fee structure.

3.4 Interest is regulated as follows:

a) The credit provider may unilaterally increase the interest rate when the change is reasonably justified by changes in the provider’s funding rates, considerations for the provider’s earnings capacity, restructuring of the provider’s borrowings or other special circumstances on the provider’s side, as well as when the change is reasonably justified by compliance with the authorities’ view on credit providers' interest rate policy. Furthermore, the credit provider may unilaterally increase the interest rate when the change is reasonably justified by individual circumstances relating to the credit; for example, if changes on the part of the credit customer mean that the credit poses increased risk to the provider.

b) Changes made pursuant to section 3.4 a) may be implemented no sooner than six weeks after the credit provider has sent written notice to the credit customer about the change. A shorter notice period may be used if the change occurs as a result of a significant change in the money market rate, bond rate or the general interest rate level for the provider's funding.

4. Objections and Claims Against the Credit Provider The credit customer may assert the same objections and monetary claims against the credit provider based on the purchase as he/she could have asserted against Mycall. In addition to making a complaint to Mycall in accordance with the sale of goods rules, the credit provider must be notified as soon as reasonably possible. If the credit customer has a monetary claim that may be asserted against the credit provider, the provider’s liability is limited to the amount received by the provider from the credit customer in connection with the purchase. 5. Change of Name and Address The credit customer is obliged to immediately notify the credit provider of any change in name or address.

Information Search in a Database
The credit provider must immediately and without cost inform the consumer of the result of a database search if a credit application is rejected on the basis of such a search. This does not apply if it is prohibited to give such information under Community regulations or where this would be contrary to the objectives of public order or security.

Right to a Draft Credit Agreement
A right, on request and without charge, to receive a copy of the draft credit agreement. This provision does not apply if at the time of the request the credit provider is not willing to proceed with entering into the credit agreement with the consumer.

If you wish to use your right of withdrawal, you must inform us no later than 14 days after you receive the delivery.
Exceptions to the right of withdrawal (hygiene products)
Sealed goods that are not suitable for return for health or hygiene reasons, such as earplugs (in-ear), are exempt from the right of withdrawal if the seal has been broken.
